A Mainland court enforcement record can materially affect a counterparty review, but the label matters. An obligation being enforced, a dishonest-debtor listing and a consumption restriction are different findings. The reviewer should establish the matching entity and case before deciding what the record says about performance, conduct or the people running the business.
Three records with different meanings
The Supreme People’s Court’s China Enforcement Information Disclosure Network publishes relevant enforcement information. Its provisions on dishonest judgment debtors and consumption restrictions set separate grounds and consequences. A dated search result should be read within those frameworks rather than translated into a general “blacklisted company” conclusion.
| Record | What it indicates | What to investigate |
|---|---|---|
| Judgment debtor — 被执行人 | A court is enforcing an obligation against the subject | Case, amount, stage and evidence of settlement |
| Dishonest judgment debtor — 失信被执行人 | Non-performance combined with a specified ground under the provisions | The recorded conduct, court decision and current listing |
| Consumption restriction — 限制消费 | A court restriction on specified spending | The order, affected persons and any lifting or permission |
A judgment-debtor entry does not, by itself, establish refusal or evasion. The dishonest-list provisions address additional grounds, including ability to perform coupled with refusal, obstruction, evasion and failures relating to reporting or enforcement arrangements. The recorded ground therefore adds information that a basic enforcement result does not supply.
Why restrictions can affect the people running a company
The consumption provisions cover specified high or non-essential spending. When the debtor is a company, they can extend to its legal representative, principal responsible person, relevant person affecting performance and actual controller. The court order and provisions determine their application; the fact that an individual manages the company does not establish a separate personal debt.
These restrictions can have practical consequences for travel and business arrangements, so a reviewer may need to understand whether they affect the customer’s ability to perform. Permission for particular spending or lifting of an order should be evidenced through the appropriate court process. A customer’s statement that the matter is settled is useful context but should be reconciled with supporting documents and the current result.
Reading a match for onboarding
Use the Chinese legal name, credit code where available, case number and court to resolve the match. A similar name is not enough to attribute adverse conduct to a company or individual. Where the result names a representative, keep that capacity distinct from the debtor identity and compare it with the relevant company record.
The amount, timing and explanation help assess the commercial significance. A disputed or settled obligation may present different questions from repeated evasion, but neither conclusion should be inferred from an untranslated label. Obtain the relevant decision or settlement evidence where material and record what remains unresolved.
A clean search is also dated evidence, not proof that no historical case existed. Preserve the result and use subsequent checks where the relationship warrants them. The legal-representative guide explains the corporate role, while the administrative-lists guide covers separate market-regulator records.
Requesting the evidence by email
An approved organisational sender can email agent@fill-easy.com with the Chinese legal name, Unified Social Credit Code, requested evidence and case reference. For example:
Please confirm availability of enforcement, dishonest-debtor and consumption-restriction evidence for [Chinese legal name], [credit code]. Reference: [case]. Identify matching case numbers, courts, record dates and current outcomes in a referenced summary.
The agent clarifies ambiguous matches or unavailable items and confirms access, availability, price and turnaround at acceptance. PDFs arrive in the same thread with source, retrieval time and request ID; an optional summary cites the records. The reviewer assesses the evidence and decides.
